You don’t care about gun regulation because the people you know aren’t going to die on account of an accidental or even intentionally shot bullet. There are neighborhoods where the fear of being shot is imminent, every day. You then ask, why cater regulation to the fears of a particular group? I respond, why cater regulation around people who don’t have a personal stake in the...
there was a beautiful pink cupcake in the fridge this morning which I ate without second thought…little did I know that it was ONE OF THOSE until I was sitting in court two hours later feeling PARTICULARLY entranced by the intricacies of the carpet design.
An Encouraging Introduction to the Law of Servitudes
Entering the study of servitudes is a little like diving into a swamp late at night, swimming and floundering in terror, and emerging quite fortuitously on some unknown shore in the morning. When it is all over you’re sorry that it happened, you don’t understand anything you saw but you know that you didn’t like it, and you...

Freedom extends beyond spatial bounds. Liberty presumes an autonomy of self that includes freedom of thought, belief, expression, and certain intimate conduct. The instant case involves liberty of the person both in its spatial and more transcendent dimensions.
[The Bowers Court failed] to appreciate the extent of the liberty at stake. To say that the issue in Bowers was simply the right to...
The truth is, a series of small actions and events ended up eliminating a problem that seemed to hang over everything. There was no miracle cure, just the intercession of a thousand smaller sanities. Ending sentencing for drug misdemeanors, decriminalizing marijuana, leaving judges free to use common sense (and, where possible, getting judges who are judges rather than politicians)—many small acts...
When the New York City police stopped and frisked kids, the main goal was not to jail them for having pot but to get their fingerprints, so that they could be identified if they committed a more serious crime. But all over America the opposite happens: marijuana possession becomes the serious crime. When the New York City police stopped and frisked kids, the main goal was not to jail them for...
Which leads, further, to one piece of radical common sense: since prison plays at best a small role in stopping even violent crime, very few people, rich or poor, should be in prison for a nonviolent crime. Neither the streets nor the society is made safer by having marijuana users or peddlers locked up, let alone with the horrific sentences now dispensed so easily. For that matter, no social good...

Yummy Yamswan is back at the library with a bag of celery sticks and a thermos of tea. Will my hypothetical client Mr. Selvaggio get away with negligently infecting his wife, Betty, with HIV? My gut says, “No way in hell,” but my research is pointing to “Maybe.”
Pre-Roe Reality
Teenagers—especially those who are poor and uneducated—are by far the group having the most elective late-term abortions. If we truly wish to protect the young and vulnerable, promote a “culture of life,” as President Bush said so grandly in his signing speech, then we must make teenage girls a top priority. Make sure they don’t get pregnant in the first place,...

Lessons in Japanese Part 1
Abbreviated Sentence endings
The student should be aware of the practice of leaving sentences unfinished. As you will see in the examples below, conversations between Japanese people frequently feature phrases that end in “but…” and “so…”
1. “I’m not sure how to read this so…” (Won’t you teach me...
From a purely analytical perspective, the death penalty might be justifiable if it deterred crime and saved lives, or if it resulted in a reduction in State costs. Studies have shown that it does neither of these things. The death penalty, therefore, can only be viewed as an institutional expression of revenge and retribution. Rather than focusing on the offender, it must be asked what the death...

In the last episode, Billy and Ari were last seen irrationally deciding to descend a slippery cliff leading to a private beach with spotted with massive boulders bracing against a stormy brigade of waves.
Billy was apparently possessed by a magical leprechaun spirit that enabled him to hop from one rock to another with ease. I, on the hand, was fumblingly clinging to every clingable jutting...

One of the remarkable things about watching media members interview politicians these days is just how bad the questions are. The journalist inevitably starts with a softball set up question that allows the candidate to offer some version of their stump speech for an answer….

Dorna was babysitting the dogs next door. Around 8, we took them for a long, rambling walk around the neighborhood. We were about a block away from home when two rottweilers came trotting across the street. They were big and muscular like gorillas and they were eyeing Abby and Vinnie and snarling. They circled us, barking throatily, snapping at our dogs. I swept up Vinnie into my arms and kicked...

Ew! Got 5 suspiciously fairy-tale red apples yesterday from the grocery store. Generally, I know better than to pick apples by their sheen but I got lots of things on my mind—the cardinal rule of apple-picking aint one of em, let me tell you.
They turned out to be mealy, my least desired trait in a fruit. Do mushy apples make for a beautiful apple crisp? Stay tuned…
